A man will not be subject to the death penalty following a court order filed Thursday. According to court documents obtained by our NBC affiliate WLWT, death penalty specifications filed against George “Billy” Wagner have been dismissed.

The final trial in the 2016 Pike County massacre case will be heard outside of the county. Additionally, two defendants in the case who earlier admitted their guilt in the eight-person homicide will be formally sentenced Dec.

George "Billy" Wagner III is charged with multiple counts, including aggravated murder, in connection with the 2016 shooting deaths of members of the Rhoden family.

On Wednesday, retired Darke County Common Pleas Court Judge Jonathan Hein dismissed the death penalty specification in the case against George “Billy” Wagner III, according to online court documents. This came about a week after Hein announced he intended to do so. Prosecutors had filed an opposition to that on Monday.

Despite a flurry of activity in the case against George “Billy” Wagner III in recent days, big questions remain with his trial in the 2016 Pike County massacre case just more than six weeks away.
